How is Delta 8 extracted?
Delta 8 can be extracted from hemp or cannabis. Nearly all Delta 8 is derived from hemp, making it less potent than Delta 9.
Is Delta 8 legal?
The 2018 Farm Bill made Delta 8 legal if it is derived from hemp. However, the Federal DEA has, in a proposed rule, indirectly classified Delta 8 as a Scheduled 1 controlled substance, that would make it federally illegal. The rule is not yet final.

Delta 8 and Delta 9 are chemically different in the placement of the double bond. Delta 8 has the double bond on the 8th carbon, while Delta 9 has it on the 9th carbon.
Delta 8 binds to the endocannabinoid system slightly differently because of the location of the double bond, which is what causes Delta 8 to be less potent.
Is Delta 8 safe?
Quality tested products usually have a QR code or batch # on the box that allows patients to look up the certificate of analysis/testing results on a producer’s website. Patients who are purchasing Delta 8 in a vape need to be sure the vape is not filled with VIT E acetate that led to thousands of hospitalizations and more than 60 deaths. Research also shows that many Delta 8 products contain compounds not allowed by state law in regulated cannabis products. Those compounds include metal, chromium, copper, nickel, and lead. Additionally, many samples contain residual traces of solvents (the chemicals used in the process to separate Delta 8 from hemp) at levels not safe for human inhalation. Those solvents include hexane, methanol, dichloromethane, ethyl acetate, heptane, acetone, and isopropanol.
